NOTICE: All bidders and other persons attending this sale agree that they have read and have full knowledge of these terms and must be registered for each respective ABC Iron auction.
INJURY AND DAMAGE: Bidder acknowledges responsibility for any personal injury or property damage caused by bidder, or his agent, and further agrees to hold ABC Iron harmless from any personal injury to himself or his agents and any property damage incurred on auction premises. All children under 18 are the sole responsibility of the adult accompanying them. I release ABC Iron and the Seller from any and all liability connected with the removal and transportation of my purchases and any and all future uses for the equipment purchased here today.
ABC Iron or the Auctioneer reserves the right to refuse any applicant for a bidding card the privilege of bidding at this auction sale and to revoke such privilege at any time.
AGENCY: The auctioneer is acting as agent only and is not responsible for the acts of its principals or consignors.
CONDITION OF ARTICLES SOLD at ABC Iron: The auctioneer is not responsible for the correct description, authenticity of, or defect in any lot, and makes no warranty in connection therewith. ABC Iron will not set aside any lot that has errors on the catalog for any reason, it is your responsibility to inspect equipment prior to lot being offered for auction.
THIS LISTING PROVIDED BY ABC IRON IS ONLY A GUIDE AND MAY NOT BE ACCURATE IN ANY WAY. EVERY ITEM WILL SELL at ABC IRON “AS IS” “WHERE IS”. PLEASE INSPECT THE EQUIPMENT PRIOR TO BIDDING. ALL SALES ARE FINAL.
TERMS - COMPLETE PAYMENT SALE DAY: ABC Iron accepts the forms of payment below. Please pay special attention to this message in order to avoid any delay on the completion of your transaction. All transactions must be paid in full on sale day, no exceptions will be made to this. In order for equipment to be released a valid gate pass will be produced to you by ABC Iron personnel once equipment is paid in full, please take special note of this as equipment will not be released without proper gate pass at anytime.

- Any and all personal or company checks will require a bank letter guaranteeing payment to ABC Iron. (The letter must be valid and current and must state that it is guaranteeing payment to ABC Iron.)
- Any and all Certified Funds (Cashiers Checks or Travelers Checks) will require a bank letter guaranteeing payment to ABC Iron.
- ABC Iron accepts Wire Transfers. However, a 10% cash deposit is required along with a bank letter guaranteeing payment to ABC Iron.
TITLES: NO TITLES WILL BE GIVEN DAY OF SALE. ABC Iron shall provide a title or paperwork to be able to register motor vehicles and/or trailers. ABC Iron reserves up to 21 business days to deliver such. In the event we are unable to provide paperwork within a 21 day period, the buyer may return the said item at their expense and receive a refund of the purchase price. If a vehicle, truck and/or trailer is clearly marked “No Title”, then a title WILL NOT be provided. ABC Iron will not guarantee Printed titles and/or Certificates of Origin on Construction Equipment (i.e. Backhoes, Loaders, Compressors, etc.) Buyers of ANY and ALL construction equipment, other than vehicles, trucks and trailers will receive an auctioneer’s notarized Bill of Sale.
DISPUTE BETWEEN BIDDERS: If a dispute occurs between bidders at the conclusion of the transaction ABC Iron reserves the right to offer or open the lot back to the disputed parties only, once the lot has been auctioned off the transaction will be final to the said buyer.
SALES TAX will be charged in state where applicable percentage announced at sale time.
REMOVAL: Any equipment purchased at an ABC Iron location must be removed from sale site as determined by ABC Iron on the date and time given during the auction. ABC Iron requires new owners (buyers) to completely dismantle the equipment for transportation. All sold equipment not removed from ABC Iron locations, prior to a time and date agreed upon at the date of the auction, will be charged a $25/day storage fee, which will be assessed to each piece of equipment, to be paid by the buyer of such equipment.
ADDITIONAL TERMS AND CONDITIONS: The auctioneer may add other terms and conditions of sale, such additional terms and conditions to be announced prior to the auction. |
